I was in an accident last month in my brand new Volvo (not even a month old!). I was rear-ended, while I was at a stop sign. That same day, I went to the police station and filed a delayed police report. Later that week, I went and got 3 different estimates, and the damage averages out to about $900. I contacted a friend of mine, who is a police officer, and they stated that I can issue a summons to the person who hit me for careless driving, and I will have to go to court. This is basically to show them that I'm not messing around. All I want is my BRAND NEW car fixed!!! I'm NOT going through my insurance because my deductible is $1,000, and the damage is less...not only that...it wasn't my fault! My insurance company advised me to have person who hit me's insurance take care of everything, at no cost to me. Here's what I need to find out...Can I send the person a demand letter, basically stating that I want them to have their insurance take care of everything? I have tried to call them, and they send me to voice mail, so reasoning is not an option any more. I don't really know how to go about this?! I want to try this on my own, and not get an attorney involved. I just want to tell them that if they fix my car, I will drop summons and further proceedings (like small-claims court, which I WILL sue for additional $$ for dealing with all this). But, what if they don't have the money? I have no idea what to do. I live in NJ, hope someone can help!

Someone without car insurance hit my car. Luckily it won't cost much but just say they had hit an expensive car and actually wrote it off, how would they pay for that?

My insurance company wants to use reconditioned parts, and they are pressuring us to accept a check made out to us and the finance company. Not enough to pay it off or fix it. My vehicle is a loaded Suzuki Grand Vitara with all kinds of electronic stuff. Which were mostly scattered across the road after the deer committed suicide. They (the insurance company) had it towed to my home after the accident because there were no dealers in the area and my home was about 100 miles closer than Dallas. Now they are saying we have to pay to have it towed the 100 miles to the nearest dealer, or use someone local. They are also saying that we contacted the towing company and they are the ones who arranged the tow. There is no one local (car repair shop) who can work on it and get it right. I am afraid if we use someone local it won't be fixed right. The estimate they gave us has parts coming from a salvage and reconditioned parts dealers. I need to find a lawyer who can make them fix it right. If it can't be fixed right then I need them to total it. I have looked in the yellow pages and all of the accident attorneys want injuries. What kind of attorney do I need for just auto damage? I have never sued anyone before. HELP!!!

I have a tricky question that I really need an answer to. I just got back from the hospital. I was working on my garage this evening and I had a terrible accident. I was ripping a piece of ply wood with my table saw and I ended up cutting my middle finger on my left hand off. I have heard that in some instances life insurance pays out. I am just wondering if maybe that would be true. The other thing I was thinking is would my homeowners insurance possibly cover something like this. I have health insurance and am not too worried about medical bills. The problem I will have is keeping up with my bills when I cant work which sounds like quite awhile until this heals. I am 22 and am on my father's insurance policy. My rates started out as only 30 dollars and increased to 50 bucks. They said that the reason my rates increased was bc I was added as a driver of the vehicle. Question about insurance liabilty when driving a drunk friend home in his car?

My friend asked me to drive his car for him to pick him up because he was drinking. I picked him up and on the way home got into a fender bender at my fault. His insurance paid for the damages done to the other vehicle, but he does not have complete coverage for his car and wants me to cover 800 dollars in damages done to his vehicle. I do not feel responsible for this. I have minimum coverage. Will he be able to take me to claims court? Am I liable for his damages?
